In short Common Law is God's Law one might say, Do not harm, steal or fraud. Statute 'Laws' are man made rules which require your consent. In reality they are not Laws.

No.

Common Law is the collected findings and decisions of your respective Court System throughout the years.
So if the highest Court in Ireland said that it would be a mark of aggression to offer someone a pancake - then in Common Law it's a mark of aggression to offer pancakes. Common Law can be alienated from reality as Legalese, or whatever it is people think they're fighting.

Gangster-speak, for instance, is making its way into Common Law Courts. The words they'd use for guns, drive-bys, drugs, and everything in between is being added to their Common Law dictionary. Because it's been found in earlier cases that "this word means this, and that word means that".

Ok I stand corrected, what was I on about then, Natural Law?

If you want, yeah.

The thing is, it's so fucking "Natural" we don't have a name for it! That's why it was so easy to forget.

COMMON LAW 1. The part of English law based on rules developed by the royal courts during the first three centuries after the Norman Conquest (1066) as a system applicable to the whole country, as opposed to local customs. The Normans did not attempt to make new law for the Country or impose French law on it; they were mainly concerned with establishing a strong central administration and safeguarding the royal revenues, and it was machinery devised for these purposes that the common law developed.

2. Rules of law developed by the courts as opposed to those created by statute.

3. A general system of law deriving exclusively from court decisions.

If we can fully develop into, (Common Decent Humans) we may well have no need for these Courts.

I propose we confuse the issue even more, and refer to this mishmash of, being nice to each other, as the CHD (Common Human Decency) LAW SYSTEM.

I am currently working on a one page CHD dictionary. Here is the Draft.

If you cause harm or loss to another, make amends, Otherwise chill the fuckout. :)

I hope this helps Nicole and does not further add to the confusion.

Morgan and Howard are on the right track, it is whatever the courts have been doing.
In recent times in this country (and many others) we have had a centralised control system with Corporations at the top (bailout?) aided by the courts tec, so you could make an argument that Corporate Socialism a.k.a. Fascism is now Common Law here.

People mean a lot of different thing when they say common law though and you might be best to ask them what they mean. Some people mean Natural Law, The Golden Rule, Ten Commandments, No Harm, Theft, Fraud or any number of other things.
